Terms of Service

1. Agreement to These Terms

These Terms of Service ("Terms") form a binding agreement between you and Forge Note ("we", "us", "our") governing your use of the Forge Note mobile application and related websites (together, the "Service").

By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and handle your data.

2. Eligibility

• You must be at least 13 years old to use the Service. Where the law of your country sets a higher minimum age for consenting to online services on your own, you must meet that age instead.
• You must be able to form a binding contract in your jurisdiction.
• The Service is intended for fitness professionals managing their own clients. It is not intended for use by children.

3. Your Account

• You are responsible for keeping your account credentials confidential.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information when creating an account.
• You may delete your account at any time from within the app, or via our account deletion page. Deletion is permanent and removes your data as described in our Privacy Policy.

4. Subscriptions, Auto-Renewal & Cancellation

Forge Note offers a free tier and a paid subscription tier ("Pro").

Prices shown are in US dollars. Actual prices are set per country by the app store and may differ based on local currency, taxes, and regional pricing. The exact price and billing period are always shown to you in the app before you confirm a purchase.

Free trial

• New accounts receive a 14-day free trial of Pro.
• The trial unlocks all Pro features. No payment method is required to start it, and nothing is charged when it ends.
• The trial is tied to your Forge Note account, not to your device. Reinstalling the app or clearing its data does not grant a new trial.
• When the trial ends, your account automatically continues on the Free tier. Your clients and training history remain accessible.
• Separately, where the app store offers its own introductory trial on a paid subscription, that offer requires a payment method and is governed by the app store. Its terms are shown to you at the point of purchase.

Auto-renewal

• Purchases and renewals are processed by Apple App Store or Google Play, not by us. We never receive or store your payment card details.
• Your subscription is tied to your app store account, not to your Forge Note account.

How to cancel

You can cancel at any time. Cancelling stops future renewals; it does not end your current paid period, and you keep Pro access until that period expires.

• iOS / App Store: Settings → your name → Subscriptions → Forge Note → Cancel Subscription
• Android / Google Play: Play Store → Profile → Payments & subscriptions → Subscriptions → Forge Note → Cancel

Deleting the app does not cancel your subscription. You must cancel through the app store.

Refunds

All payments are processed by the app stores, so refunds are handled under their policies, not ours:

• Apple: request a refund at reportaproblem.apple.com
• Google Play: request a refund through your Google Play subscriptions page

If you believe you were charged in error, contact us at support@forgenote.app and we will try to help, though the final decision rests with the app store.

Price and plan changes

• We may change subscription prices or what each plan includes. We will give you reasonable advance notice.
• Price increases take effect only at your next renewal, and only after any consent required by the app store or applicable law.
• If you do not accept a price change, you may cancel before the change takes effect.

5. Your Content and Your Clients' Data

You retain ownership of everything you put into the Service — client records, training sessions, notes, and generated share cards ("Your Content"). We do not claim ownership of Your Content.

You grant us a limited licence to store, process, and transmit Your Content solely to operate and provide the Service to you (for example, syncing it between your devices, or sending a voice transcript to our AI provider so it can be parsed).

6. Acceptable Use

You agree not to:

• Use the Service to store or transmit unlawful, abusive, or infringing content;
• Upload another person's information without the rights or consent needed to do so;
• Attempt to gain unauthorised access to the Service, other accounts, or our infrastructure;
• Reverse engineer, decompile, or attempt to extract our source code, except where such restriction is prohibited by law;
• Use automated means to access the Service in a way that places unreasonable load on it, or to circumvent usage limits such as AI parsing quotas;
• Resell, sublicense, or redistribute the Service without our written permission.

We may suspend or terminate accounts that violate these rules.

7. AI Features and Estimates

The Service uses AI to transcribe speech and parse it into structured training entries, and calculates estimated calorie figures.

• Voice transcripts are sent to our AI provider for parsing, as described in our Privacy Policy. They are not used to train third-party models.
• AI parsing on the Free tier is limited to 5 requests per calendar month. The counter resets at the start of each month.
• We may apply reasonable rate limits to protect the Service, and may change AI providers or models.

8. Not Medical or Professional Advice

You are solely responsible for the training programmes you design and the advice you give your clients. Exercise carries inherent risk of injury. We are not responsible for injuries, health outcomes, or decisions arising from your use of the Service.

9. Share Cards and Share Links

• Share cards you generate are yours to use.
• If you create a share link, anyone with that link can view the training information it contains. Treat links as unlisted, not private.
• You are responsible for deciding what to share and with whom, including any client information contained in a card or link.
• Free tier share cards include a Forge Note watermark. Pro lets you replace it with your own name.

10. Service Availability and Changes

• We aim to keep the Service available but do not guarantee uninterrupted or error-free operation.
• We may modify, suspend, or discontinue features. If we discontinue a material paid feature, we will give reasonable notice and, where required, a pro-rata refund via the app store.
• Your training data is stored on your device as well as in the cloud, so core records remain readable if the network is unavailable.
• We may need to perform maintenance that temporarily interrupts the Service.

11. Third-Party Services

The Service relies on third parties including Google Firebase (authentication, database, hosting), our AI provider for voice parsing, and RevenueCat with the Apple App Store and Google Play for subscriptions. Their handling of data is described in our Privacy Policy. Your use of the app stores is additionally governed by their own terms.

12. Termination

• By you: stop using the Service and delete your account at any time. Cancel any active subscription through your app store separately.
• By us: we may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. Except in cases of abuse or legal requirement, we will give you reasonable notice.
• On termination, your right to use the Service ends. Data deletion follows our Privacy Policy.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will meet your requirements, that AI parsing will be accurate, or that data will never be lost. You are responsible for keeping your own copies of important records; the app provides CSV export for this purpose.

14. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, or lost data.
• Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD 50.

Some jurisdictions do not allow certain exclusions or limitations of liability. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including, where applicable, liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law. If you are a consumer, you keep all rights granted to you by the mandatory law of your country of residence.

15. Indemnity

You agree to indemnify and hold us harmless from claims, damages, and reasonable costs arising from your use of the Service in breach of these Terms or applicable law, including claims brought by your clients relating to information you recorded or shared about them.

16. Changes to These Terms

• We may update these Terms. We will update the "Last updated" date above.
• For material changes, we will notify you through a prominent in-app notice or by email before they take effect.
• Continued use of the Service after changes take effect constitutes acceptance. If you disagree, stop using the Service and cancel any subscription.

17. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which Forge Note is established, without regard to conflict-of-laws rules, except that if you are a consumer, you may also rely on the mandatory consumer protection laws of your country of residence and may bring proceedings there where that law so permits.

Before starting formal proceedings, we ask that you contact us at support@forgenote.app so we can try to resolve the matter directly.

18. General

• Entire agreement: these Terms and the Privacy Policy are the entire agreement between us regarding the Service.
• Severability: if a provision is held unenforceable, the rest remains in force.
• No waiver: failure to enforce a provision is not a waiver of it.
• Assignment: you may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• Apple-specific: where you obtained the app from the Apple App Store, these Terms are between you and us only, not with Apple. Apple has no obligation to provide support or maintenance for the app, and is not responsible for any claims relating to it. Apple is a third-party beneficiary of these Terms and may enforce them against you.
